Gelius neighbor threatened lawyer for two days – VG

When NRK korrenspondent Jon Gelius came home from the United States, he wanted to redeem their half of the plot on Røa in Oslo. He was willing to pay over 900,000 cash for 825 square meters, but first he had to solve a seven year old neighbor conflict.

– What Jon Gelius actually purchased is clear from the sales prospectus from May 1997, asserts NRK Profile lawyer, Torkjell Solbø, the Oslo District Court.

Impeccably conditions

Gelius and his former neighbor in the condominium, an elderly woman, had an impeccable relationship for nearly 10 years. According to lawyer Solbø was Gelius willing to accept a certain bias.

He suggested moving a hedge three to four meters, allowing use of the garden area was more in relation to the ownership ratio of the condominium.

But the older woman refuses and refers to an old usufruct agreement from 1997 that was signed with the former owner of the section to Gelius, who thinks that he is not bound by the agreement from 1997, but let it pass until a possible new ownership of the neighboring section.

In 2011 inherits the current landowner, Ole Ruud, all leasehold area on Røa where residential condominium to Gelius housed. Anyone who rents leasehold will be offered to redeem them.

Bob dies

Only then discovers Gelius that only housing stock, not the use of the outdoor area, was registered , claiming NRK journalist’s lawyer.

In autumn 2011 dies the older woman. Gelius tries according Solbø getting adjusted garden borders and use of common grounds with the estate who managed neighbor section, but to no avail.

Threaten lawyer

It does not go more than two days before Gelius receive a letter from the new owners, who denies that their intention is to align the use of the outdoor area and removing a separate hedge in the garden.

“There is no durable legal basis for removing the stern,” writes Otterstad and Lohne which also threaten the use of attorney unless the couple Gelius accept usufruct agreement from 1997.

In reply letter, Jon Gelius that he finds it very surprising that the new neighbors forward by threat of injunction two days after the first meeting of the condominium.

Communication through counsel, is no good way to usher in a neighbor relationship on, says NRK profile.
